New Labor/Justice Memorandum Targets H-2 Visa Employers

Employers turning to the H-2A and H-2B visa programs for labor relief face additional scrutiny. On July 31, the Departments of Justice (DOJ) and Labor (DOL) announced a new memorandum of understanding that expands information sharing between the two agencies. Under the agreement, the DOL will refer cases of potential discrimination to the DOJ. The DOJ will refer potential cases of noncompliance with visa program requirements to the DOL.
